Depuis, la loi facilite la gestion de l\u2019indivision car elle distingue trois r\u00e8gles selon le type d&#8217;actes concern\u00e9s&nbsp;:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Les actes conservatoires destin\u00e9s \u00e0 maintenir le patrimoine en bon \u00e9tat (par exemple la r\u00e9paration d\u2019une toiture) : chaque indivisaire peut agir sans avoir \u00e0 demander le consentement des autres, ce qui n\u2019est pas le cas quand il s\u2019agit de sortir d\u2019une indivision.<\/li>\n\n\n\n<li>Les actes d&#8217;administration, de gestion courante d&#8217;exploitation (par exemple la vente de meubles d\u2019usage courant)&nbsp;: ces actes n\u00e9cessitent la majorit\u00e9 aux deux tiers des droits indivis.<\/li>\n\n\n\n<li>Les actes de disposition qui modifient la consistance du patrimoine (par exemple la vente d\u2019un bien)&nbsp;: ces actes n\u00e9cessitent l&#8217;unanimit\u00e9.<\/li>\n<\/ul>\n\n<\/div><\/div><\/div>\n\n<div class=\"gb-grid-column class=\"gb-inside-container\">\n\n<p class=\"gb-headline gb-headline-cceea670 gb-headline-text\">Pour vendre un bien, il faut donc l\u2019unanimit\u00e9 des indivisaires. N\u00e9anmoins <a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?idArticle=LEGIARTI000006432351&amp;cidTexte=LEGITEXT000006070721\" target=\"_blank\" rel=\"noreferrer noopener\">l\u2019article 815 du Code civil<\/a> stipule que &#8220;<em>Nul ne peut \u00eatre contraint \u00e0 demeurer dans l&#8217;indivision et le partage peut toujours \u00eatre provoqu\u00e9, \u00e0 moins qu&#8217;il n&#8217;y ait \u00e9t\u00e9 sursis par jugement ou convention.&#8221;<\/em><\/p>\n\n\n\n<p class=\"gb-headline gb-headline-3a7ce0c8 gb-headline-text\">Ainsi \u00e0 tout moment, un indivisaire peut prendre la <a href=\"https:\/\/stop-indivision.com\/5-bonnes-raisons-de-sortir-de-lindivision\/\" target=\"_blank\" rel=\"noreferrer noopener\">d\u00e9cision de sortir d\u2019une indivision<\/a>. Trois possibilit\u00e9s peuvent \u00eatre envisag\u00e9es dans ce cadre&nbsp;:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>la vente de ses parts \u00e0 un autre indivisaire&nbsp;;<\/li>\n\n\n\n<li>la vente du bien dans sa totalit\u00e9, une partie des autres copropri\u00e9taires souhaitant \u00e9galement sortir de l\u2019indivision&nbsp;;<\/li>\n\n\n\n<li>la vente de ses parts \u00e0 un tiers.<\/li>\n<\/ul>\n\n\n\n<p class=\"gb-headline gb-headline-55e3910b gb-headline-text\">La premi\u00e8re solution est \u00e9videmment la plus simple.<\/p>\n\n\n\n<h6 class=\"gb-headline gb-headline-0d86faee\"><span class=\"gb-icon\"><svg aria-hidden=\"true\" role=\"img\" height=\"1em\" width=\"1em\" viewBox=\"0 0 576 512\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\"><path fill=\"currentColor\" d=\"M576 240c0-23.63-12.95-44.04-32-55.12V32.01C544 23.26 537.02 0 512 0c-7.12 0-14.19 2.38-19.98 7.02l-85.03 68.03C364.28 109.19 310.66 128 256 128H64c-35.35 0-64 28.65-64 64v96c0 35.35 28.65 64 64 64h33.7c-1.39 10.48-2.18 21.14-2.18 32 0 39.77 9.26 77.35 25.56 110.94 5.19 10.69 16.52 17.06 28.4 17.06h74.28c26.05 0 41.69-29.84 25.9-50.56-16.4-21.52-26.15-48.36-26.15-77.44 0-11.11 1.62-21.79 4.41-32H256c54.66 0 108.28 18.81 150.98 52.95l85.03 68.03a32.023 32.023 0 0 0 19.98 7.02c24.92 0 32-22.78 32-32V295.13C563.05 284.04 576 263.63 576 240zm-96 141.42l-33.05-26.44C392.95 311.78 325.12 288 256 288v-96c69.12 0 136.95-23.78 190.95-66.98L480 98.58v282.84z\"><\/path><\/svg><\/span><span class=\"gb-headline-text\">Malheureusement les conflits familiaux, les ranc\u0153urs am\u00e8nent trop souvent une partie des indivisaires \u00e0 s&#8217;opposer \u00e0 la vente du bien.<\/span><\/h6>\n\n\n\n<p class=\"gb-headline gb-headline-4e7f87e1 gb-headline-text\">Depuis la loi de simplification du droit du<a href=\"http:\/\/www.legifrance.gouv.fr\/affichTexte.do?cidTexte=JORFTEXT000020604162&amp;categorieLien=id\" target=\"_blank\" rel=\"noreferrer noopener\">&nbsp;12 mai 2009 n\u00b02009-526<\/a>, si les personnes ayant choisi de <a href=\"https:\/\/stop-indivision.com\/lu\/rachat-de-parts-indivises\/\" target=\"_blank\" rel=\"noreferrer noopener\">sortir d\u2019une indivision par la vente du bien<\/a> repr\u00e9sentent au moins 2\/3 des droits indivis, la vente peut \u00eatre autoris\u00e9e.<\/p>\n\n\n\n<p class=\"gb-headline gb-headline-8bc65a78 gb-headline-text\">Apr\u00e8s avoir v\u00e9rifi\u00e9 que la demande est recevable, le notaire lancera la proc\u00e9dure de vente et informera, par voie d&#8217;huissier, les autres indivisaires de la volont\u00e9 commune de certains indivisaires (\u2154 des parts) de vendre le bien. Les autres propri\u00e9taires pourront alors adopter deux attitudes face \u00e0 cette information&nbsp;:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Notifier leur acceptation dans un d\u00e9lai de trois mois. La vente pourra \u00eatre r\u00e9alis\u00e9e, et dans ce cas les personnes qui le souhaitent pourront sortir d\u2019une indivision aussit\u00f4t l\u2019op\u00e9ration conclue.<\/li>\n\n\n\n<li>Refuser ou ne pas r\u00e9pondre (qui \u00e9quivaut \u00e0 un refus dans un d\u00e9lai de 3 mois).<\/li>\n<\/ul>\n\n\n\n<p class=\"gb-headline gb-headline-b8c76b7d gb-headline-text\">En cas de refus, le notaire le constatera par un \u00ab&nbsp;proc\u00e8s-verbal de difficult\u00e9s&nbsp;\u00bb. Entre la d\u00e9marche aupr\u00e8s du notaire et la saisie du tribunal, il peut s&#8217;\u00e9couler sur plusieurs ann\u00e9es.<\/span><\/h6>\n\n<\/div><\/div><\/div>\n\n<div class=\"gb-grid-column gb-grid-column-f537dde8\"><div class=\"gb-container gb-container-f537dde8\"><div class=\"gb-inside-container\">\n\n<h2 class=\"gb-headline gb-headline-9de70bec gb-headline-text\">Vente des parts indivises \u00e0 un tiers<\/h2>\n\n<\/div><\/div><\/div>\n\n<div class=\"gb-grid-column gb-grid-column-99c4abf9\"><div class=\"gb-container gb-container-99c4abf9\"><div class=\"gb-inside-container\">\n\n<p class=\"gb-headline gb-headline-819fd7c1 gb-headline-text\">Selon <a href=\"https:\/\/www.legifrance.gouv.fr\/affichCodeArticle.do?cidTexte=LEGITEXT000006070721&amp;idArticle=LEGIARTI000006432468&amp;dateTexte=&amp;categorieLien=cid\">l\u2019article 815-14 du Code civil<\/a>, la vente de parts indivises \u00e0 un tiers est possible : <em>\u201cL&#8217;indivisaire qui entend c\u00e9der, \u00e0 titre on\u00e9reux, \u00e0 une personne \u00e9trang\u00e8re \u00e0 l&#8217;indivision, tout ou partie de ses droits dans les biens indivis ou dans un ou plusieurs de ces biens est tenu de notifier par acte extrajudiciaire aux autres indivisaires le prix et les conditions de la cession projet\u00e9e ainsi que les nom, domicile et profession de la personne qui se propose d&#8217;acqu\u00e9rir. <\/em><em>Tout indivisaire peut, dans le d\u00e9lai d&#8217;un mois qui suit cette notification, faire conna\u00eetre au c\u00e9dant, par acte extrajudiciaire, qu&#8217;il exerce un droit de pr\u00e9emption aux prix et conditions qui lui ont \u00e9t\u00e9 notifi\u00e9s.\u201d<\/em><\/p>\n\n\n\n<p class=\"gb-headline gb-headline-b097749e gb-headline-text\">Ainsi, avant de sortir d\u2019une indivision par la vente de ses parts \u00e0 un tiers, la loi impose d\u2019informer les autres propri\u00e9taires car ils sont prioritaires sur l\u2019achat du bien. Il s\u2019agit du <a href=\"https:\/\/stop-indivision.com\/indivision-et-droit-de-preemption-procedure-et-prerogatives-des-indivisaires\/\" target=\"_blank\" rel=\"noreferrer noopener\">droit de pr\u00e9emption<\/a>.<\/p>\n\n\n\n<p class=\"gb-headline gb-headline-135d1ed1 gb-headline-text\">Si un indivisaire est int\u00e9ress\u00e9 par le rachat des parts, il dispose alors d&#8217;un d\u00e9lai d&#8217;un mois pour vous le faire savoir par voie d&#8217;huissier. L&#8217;acte de vente devra alors \u00eatre sign\u00e9 dans les deux mois qui suivront. Pass\u00e9 ce d\u00e9lai, si rien ne s&#8217;est pass\u00e9, il s\u2019agira de mettre l&#8217;indivisaire en demeure de signer la vente.<\/p>\n\n\n\n<p class=\"gb-headline gb-headline-64a3a315 gb-headline-text\">Si cette mise en demeure reste sans effet, au bout de 15 jours, l\u2019indivisaire pourra vendre librement ses parts \u00e0 l\u2019acheteur de son choix.<\/p>\n\n<\/div><\/div><\/div>\n\n<div class=\"gb-grid-column gb-grid-column-646b2ae3\"><div class=\"gb-container gb-container-646b2ae3\"><div class=\"gb-inside-container\">\n<div
