N\u00e9anmoins, et selon les cas de figure, il est possible que <a href=\"https:\/\/stop-indivision.com\/est-ce-quun-heritier-peut-bloquer-une-vente\/\" target=\"_blank\" rel=\"noreferrer noopener\">les co-indivisaires bloquent un projet de vente<\/a>. Nul n\u2019\u00e9tant tenu de demeurer en indivision, quelles sont alors les solutions qui s\u2019offrent \u00e0 vous pour forcer la vente en indivision ?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Forcer la vente en indivision : la r\u00e8gle des 2\/3<\/h2>\n\n\n\n<p>La <a href=\"https:\/\/stop-indivision.com\/sortir-indivision\/\" target=\"_blank\" rel=\"noreferrer noopener\">nouvelle loi de 2009 pour la simplification des proc\u00e9dures<\/a> a d\u00e9rog\u00e9 au principe jusqu\u2019ci en vigueur de la majorit\u00e9 des voies pour proc\u00e9der \u00e0 la vente d\u2019un bien en indivision. D\u00e9sormais, <strong>c\u2019est la r\u00e8gle des 2\/3 des droits sur le patrimoine indivis qui pr\u00e9vaut<\/strong>. C\u2019est-\u00e0-dire qu\u2019en cas de volont\u00e9 de vente, l&#8217;indivisaire doit faire parvenir l\u2019information de son projet \u00e0 l\u2019ensemble des propri\u00e9taires dans un d\u00e9lai de trois mois. Ses homologues ont alors un mois pour se prononcer sur la vente.<\/p>\n\n\n\n<p>Si unanimit\u00e9 il y a sur la vente, les situations conflictuelles sont \u00e9vit\u00e9es et la cession peut se faire ais\u00e9ment. Dans le cas contraire, et si un indivisaire indique son refus, la vente n\u2019est pas pour autant imm\u00e9diatement et irr\u00e9m\u00e9diablement bloqu\u00e9e. Le projet de vente d\u2019un bien en indivision qui regroupe l\u2019accord des indivisaires qui d\u00e9tiennent conjointement les 2\/3 de la valeur totale des biens indivis (attention, il ne s\u2019agit donc pas de regrouper les 2\/3 du nombre d\u2019indivisaires) peut malgr\u00e9 tout aboutir.<\/p>\n\n\n\n<p>Notez qu\u2019il est \u00e9galement possible de choisir de <a href=\"https:\/\/stop-indivision.com\/rachat-de-parts-indivises\/\" target=\"_blank\" rel=\"noreferrer noopener\">vendre sa quote-part de l&#8217;indivision<\/a> (\u00e0 un autre indivisaire ou \u00e0 une tierce personne). Cette solution permet \u00e0 l\u2019indivisaire qui le d\u00e9sire de <a href=\"https:\/\/stop-indivision.com\/sortir-indivision\/\" target=\"_blank\" rel=\"noreferrer noopener\">sortir d\u00e9finitivement de l&#8217;indivision<\/a> sans avoir besoin de forcer la vente.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Voie judiciaire : comment forcer la vente en indivision ?<\/h2>\n\n\n\n<p>Lorsque les indivisaires restants continuent de s\u2019opposer \u00e0 la vente et que le notaire a d\u00fbment dress\u00e9 le proc\u00e8s-verbal de difficult\u00e9s,<strong> il est envisageable de saisir le TGI <\/strong>du lieu de constitution de l&#8217;indivision. Le juge appr\u00e9ciera le contexte de la vente et ne pourra prononcer une vente forc\u00e9e que si elle ne porte pas un pr\u00e9judice financier important aux autres indivisaires. Il faut aussi que la vente envisag\u00e9e, pour \u00eatre forc\u00e9e par le juge, respecte les droits des propri\u00e9taires minoritaires. Cette atteinte excessive peut \u00eatre d\u2019ordre financier, moral ou mat\u00e9riel.<\/p>\n\n\n\n<p><strong>La saisine du Tribunal de Grande Instance<\/strong> en vue de forcer la vente en indivision peut \u00e9galement intervenir dans le but de demander le partage judiciaire des biens de la succession. L\u2019assignation s&#8217;effectue par d\u00e9p\u00f4t de la requ\u00eate au greffe du tribunal judiciaire et notifi\u00e9e aux autres indivisaires par huissier de justice.<\/p>\n\n\n\n<p>Une fois la d\u00e9cision de forcer la vente prise, les indivisaires peuvent toujours revenir sur leurs d\u00e9clarations et choisir le partage \u00e0 l\u2019amiable. Dans le cas contraire, <a href=\"https:\/\/stop-indivision.com\/pourquoi-la-sortie-dune-indivision-se-fait-parfois-par-une-vente-aux-encheres\/\" target=\"_blank\" rel=\"noreferrer noopener\">on proc\u00e9dera \u00e0 la vente aux ench\u00e8res<\/a> des biens du patrimoine commun : c\u2019est <a href=\"https:\/\/stop-indivision.com\/licitation-et-indivision-le-point\/\" target=\"_blank\" rel=\"noreferrer noopener\">la licitation<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Exceptions \u00e0 la vente forc\u00e9e d\u2019un bien en indivision<\/h2>\n\n\n\n<p>Il existe des situations dans lesquelles m\u00eame le juge ne peut pas forcer la vente en indivision.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Lorsque la succession fait l\u2019objet de proc\u00e9dures de d\u00e9membrement de propri\u00e9t\u00e9s. C\u2019est-\u00e0-dire que certains indivisaires d\u00e9tiennent la nue-propri\u00e9t\u00e9 des biens et d\u2019autres l\u2019usufruit.<\/li>\n\n\n\n<li>Un ou plusieurs indivisaires ne peuvent manifester leur volont\u00e9 ou leur refus de vendre : h\u00e9ritier introuvable, qui fait l\u2019objet d\u2019une mesure de protection (curatelle ou tutelle), ou personne frapp\u00e9e d\u2019incapacit\u00e9, etc.<\/li>\n\n\n\n<li>Lorsqu\u2019il est apport\u00e9 la preuve d\u2019un pr\u00e9judice important du fait de la vente.
