Ce r\u00e9gime juridique suppose alors l\u2019unanimit\u00e9 et l\u2019accord de tous les indivisaires pour ce qui concerne les travaux d\u2019entretien aff\u00e9rents au bien, sa vente, etc. Il est possible que les indivisaires ne souhaitent pas rester li\u00e9s par ce r\u00e9gime et <a href=\"https:\/\/stop-indivision.com\/sortir-indivision\/\" target=\"_blank\" rel=\"noreferrer noopener\">sortir de la succession est alors un droit<\/a>. Pour y parvenir, ils peuvent d\u00e9cider de vendre leurs parts de propri\u00e9t\u00e9 \u00e0 un autre co-indivisaire ou \u00e0 une tierce personne. En cas de cession, comment les propri\u00e9taires restants peuvent faire valoir leur droit de pr\u00e9emption indivisaire pour acqu\u00e9rir en priorit\u00e9 les parts mises en vente ?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Les principes du droit de pr\u00e9emption indivisaire<\/h2>\n\n\n\n<p>Par principe, lorsque plusieurs indivisaires se trouvent \u00eatre propri\u00e9taires d\u2019un bien en indivision, ils b\u00e9n\u00e9ficient tous des m\u00eames droits de propri\u00e9t\u00e9 \u00e0 hauteur de leur quote-part sur le bien.<\/p>\n\n\n\n<p>Au titre de ce r\u00e9gime juridique, c\u2019est <strong>l\u2019unanimit\u00e9 et l\u2019accord majoritaire qui pr\u00e9vaut<\/strong> : les indivisaires doivent imp\u00e9rativement et unanimement autoriser la vente du bien, concorder sur les d\u00e9marches \u00e0 effectuer pour l\u2019am\u00e9liorer ou pour l\u2019entretenir, etc.<\/p>\n\n\n\n<p>Or, nul n\u2019est tenu de rester en indivision s\u2019il ne le d\u00e9sire pas. Par cons\u00e9quent, il est possible pour tout indivisaire de <a href=\"https:\/\/stop-indivision.com\/combien-de-temps-pour-sortir-de-lindivision\/\">sortir de la succession en vendant ses parts<\/a> ou en proc\u00e9dant \u00e0 la vente conjointe du bien indivis. Dans le contexte d\u2019une succession qui n\u2019a pas encore \u00e9t\u00e9 partag\u00e9e, une vente des parts d\u2019une indivision s\u2019appelle la licitation (elle peut \u00eatre volontaire ou judiciaire).<\/p>\n\n\n\n<p>Il est possible que les autres propri\u00e9taires concern\u00e9s par l\u2019indivision refusent ladite vente. Ils b\u00e9n\u00e9ficient alors d\u2019un droit de pr\u00e9emption indivisaire leur offrant une priorit\u00e9 sur l\u2019acquisition : en utilisant cette pr\u00e9rogative, ils se substituent \u00e0 l\u2019\u00e9ventuel acheteur. Le <strong>droit de pr\u00e9emption indivisaire consiste donc en une protection des co-propri\u00e9taires<\/strong>, il est inscrit et prot\u00e9g\u00e9 dans <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000006432469\" target=\"_blank\" rel=\"noreferrer noopener\">l\u2019article 815-14 du Code civil<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Application et utilisation de son droit de pr\u00e9emption en cas de vente de l\u2019indivision.<\/h2>\n\n\n\n<p>Quelle que soit son origine (d\u00e9c\u00e8s, divorce, convention) ou sa forme (pleine propri\u00e9t\u00e9, nue-propri\u00e9t\u00e9, usufruit, etc), une indivision peut \u00eatre vendue et le droit de pr\u00e9emption des indivisaires s\u2019appliquer.<\/p>\n\n\n\n<p>Attention, en cas d\u2019une <strong>indivision d\u2019une propri\u00e9t\u00e9 d\u00e9membr\u00e9e<\/strong>, un usufruitier ou un nu-propri\u00e9taire dispose \u00e9galement d\u2019un droit de pr\u00e9emption (dit droit de pr\u00e9emption subsidiaire). La <strong>cession du bien doit donc imp\u00e9rativement lui \u00eatre d\u00fbment notifi\u00e9e<\/strong>. Son droit de priorit\u00e9 sera applicable si aucun autre nu-propri\u00e9taire ou usufruitier direct ne se porte acqu\u00e9reur.<\/p>\n\n\n\n<p>Lorsqu\u2019un coindivisaire <a href=\"https:\/\/stop-indivision.com\/indivision-vendre-sa-part\/\" target=\"_blank\" rel=\"noreferrer noopener\">souhaite vendre ses droits ou sa quote-part<\/a>, il doit en informer ses co-propri\u00e9taires. La notification doit imp\u00e9rativement parvenir \u00e0 chaque membre de l\u2019indivision par huissier de justice, il s\u2019agit d\u2019un acte dit extrajudiciaire. Elle doit comporter, pour \u00eatre valable et ouvrir la proc\u00e9dure :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Les r\u00e9f\u00e9rences de l\u2019indivisaire vendeur qui d\u00e9pose la requ\u00eate : noms, domicile, profession.<\/li>\n\n\n\n<li>Le prix de la cession.<\/li>\n\n\n\n<li>Les r\u00e9f\u00e9rences des acheteurs d\u00e9sireux d\u2019acqu\u00e9rir les parts.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">D\u00e9lai d\u2019un mois pour exercer son droit de pr\u00e9emption<\/h2>\n\n\n\n<p>\u00c0 la r\u00e9ception de l\u2019information, les autres indivisaires disposent d\u2019un mois pour donner une r\u00e9ponse et exercer, s\u2019ils le d\u00e9sirent, leur droit de pr\u00e9emption. Si un indivisaire a l\u2019intention de pr\u00e9empter la vente, il dispose d\u2019un d\u00e9lai de deux mois pour effectivement r\u00e9aliser l\u2019achat devant un notaire.<\/p>\n\n\n\n<p>S\u2019il d\u00e9passe ce d\u00e9lai, et apr\u00e8s une mise en demeure elle-m\u00eame ignor\u00e9e, sa d\u00e9claration de pr\u00e9emption est par cons\u00e9quent consid\u00e9r\u00e9e comme nulle de plein droit. Le co-propri\u00e9taire vendeur pourra alors se retourner contre lui pour obtenir une r\u00e9paration de son pr\u00e9judice subi du fait de sa d\u00e9claration rest\u00e9e sans effet.<\/p>\n\n\n\n<p>Il est aussi possible que plusieurs indivisaires exercent leur droit de pr\u00e9emption.
