Par exemple, avant d\u2019arriver \u00e0 un contentieux, les indivisaires peuvent utiliser de nombreuses voies de recours : <strong>r\u00e8gle des 2\/3, ventre entre copropri\u00e9taires, etc<\/strong>.<\/p>\n\n\n\n<p>En effet, la loi pr\u00e9voit une disposition permettant de d\u00e9bloquer une indivision et qui offre d\u2019ali\u00e9ner le bien indivis \u00e0 la majorit\u00e9 des copropri\u00e9taires d\u00e9tenant <strong>au total des 2\/3 de la valeur de la succession<\/strong>. Ces indivisaires peuvent se mettre d\u2019accord pour effecteur certains actes importants sur les biens indivis (vente, hypoth\u00e8que, etc). Ils devront justifier devant un notaire leur volont\u00e9 et passeront par la proc\u00e9dure de la <a href=\"https:\/\/stop-indivision.com\/licitation-et-indivision-le-point\/\" target=\"_blank\" rel=\"noreferrer noopener\">licitation judiciaire face aux tribunaux<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">D\u00e9bloquer une indivision \u00e0 l\u2019amiable<\/h2>\n\n\n\n<p>D\u00e9bloquer une indivision \u00e0 l&#8217;amiable peut \u00eatre r\u00e9alis\u00e9 par les coindivisaires gr\u00e2ce \u00e0 plusieurs \u00e9tapes et d\u00e9marches collaboratives. Le juge, s\u2019il appr\u00e9cie l\u2019int\u00e9r\u00eat commun souverainement, doit justifier sa d\u00e9cision aupr\u00e8s de tous les indivisaires. Une fois autoris\u00e9, cet acte ne peut pas \u00eatre contest\u00e9 par les autres copropri\u00e9taires.<\/p>\n\n\n\n<p>Outre la d\u00e9cision en vue de la protection de l\u2019int\u00e9r\u00eat commun, le juge peut prescrire des mesures urgentes (ici aussi, rendues n\u00e9cessaires par l\u2019int\u00e9r\u00eat commun des indivisaires ou par la sauvegarde du patrimoine concern\u00e9). La preuve de l\u2019urgence de la situation est \u00e0 apporter au juge et il faut soumettre pour chaque acte demand\u00e9 une preuve directe.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">D\u00e9bloquer une indivision : zoom sur la licitation judiciaire<\/h2>\n\n\n\n<p>Quand une indivision est d\u00e9bloqu\u00e9e (ou partag\u00e9e) par le juge, on parle de licitation judiciaire. Il s\u2019agit de la mise en <a href=\"https:\/\/stop-indivision.com\/pourquoi-la-sortie-dune-indivision-se-fait-parfois-par-une-vente-aux-encheres\/\" target=\"_blank\" rel=\"noreferrer noopener\">vente aux ench\u00e8res d\u2019un bien indivis<\/a> conform\u00e9ment \u00e0 la volont\u00e9 des copropri\u00e9taires d\u00e9tenant les 2\/3 de la valeur des parts sur la succession.<\/p>\n\n\n\n<p>Cette proc\u00e9dure devra se d\u00e9rouler devant le tribunal judiciaire du lieu d\u2019ouverture de la succession concern\u00e9e (soit le dernier domicile du d\u00e9funt). Le ou les co-indivisaires qui assignent leurs co-propri\u00e9taires en justice doivent mentionner dans leur requ\u00eate :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Le patrimoine \u00e0 partager.<\/li>\n\n\n\n<li>Les pr\u00e9tentions des demandeurs au partage.<\/li>\n\n\n\n<li>Les diligences effectu\u00e9es au pr\u00e9alable en vue de trouver un accord amiable.<\/li>\n<\/ul>\n\n\n\n<p>Apr\u00e8s avoir \u00e9t\u00e9 saisi, le juge peut d\u00e9bloquer une indivision en d\u00e9signant un notaire pour qu\u2019il proc\u00e8de \u00e0 la vente aux ench\u00e8res des biens indivis.
